The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the crisis triggered by the presentation of a new comprehensive peace framework for ending the war appeared – briefly – to have been contained. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its countermove: a renewed assault of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of conflicting incidents captured the bleak nature of the current period. By day, negotiation efforts are conducted: optimistic declarations are delivered from different nations. Significant resources is expended on containing specific proposals. By night, the Kremlin brutally reminds the world that, for them, military action persists as the main instrument for achieving "resolution".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is able to track projectile deployments from Russian territory, a capacity enabled by current data. From witness perspectives, military aircraft that had been deployed to intercept incoming cruise missiles roared overhead – modern combat jets delivered to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons engaged: defensive missiles deployed against a incoming threat. This was a modern interception technology at work, presumably supplied through allied countries. Every launch shakes the surroundings, rattling buildings. The moment of terror quickly gives way to grim resignation: perhaps the hostile projectile won't hit its mark this time, preventing destruction from devastation and further power outages.

Continuous Dangers

Following this, a heavy machine gun fired at a drone close by, part of a defensive team – most likely imported technology. Regrettably, the bullets missed the opposing UAV – it maintained course toward its target.

With pauses, this carried on until dawn. Kyiv greeted the daybreak reports: seven people killed, devastation and utility failures in multiple buildings as a result of the evening attack. As customarily, everyone still continued their routines – enduring hostilities. But those entire period illustrated Ukraine's critical military reliance on international aid – a dependence that regional partners are clearly incapable to fill in the short term.

Failed Diplomacy

The 28-point plan from US administration generated strong feelings, debate and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new initiative from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually win the battle. This cycle will, no doubt, endure.

Strategic Calculations

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a assumption understood by international relations experts: you cannot secure via talks what you have failed to defend militarily. The American government assumes that it is impossible to force Russia to relinquish the areas that it already controls in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, American administration does little to deter Moscow, through statements or actions, from believing that the situation will not shift further in its advantage in the near future.

Divergent Views

Therefore, Russian leadership is convinced that time is on his side – that Ukraine and its partners are approaching exhaustion. Their incentive to accept conditions that does not give them the maximum possible gain is almost completely absent. There may be multiple initiatives to stop fighting, but they will persist as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding people and territory but averting a entire defensive failure until situations evolve in its advantage.

Existing Situation

Factually, there are no genuine requirements for a truce. Now, personal considerations are becoming relevant: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any proposal Kyiv finds unworkable, so that their priority does not move to internal issues. And although their objective will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Assessment and Future

It took a only one week to kill the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the rest of Europe, along with soothing efforts of diplomats, and finally, current information leaks, all achieved their purpose.

While new proposals based on old ideas are approaching, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and demonstrate certain reluctance to change the course of events, if they stand together and enhance their military capacity at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
